Terms of Service.

These Terms of Service (“Terms”) are a binding agreement between you and White Intel LLC, a Delaware limited liability company with its registered office at 1111B S. Governors Ave, STE 7520, Dover, DE 19904, USA (“White Intel,” “we,” “us”), governing your access to and use of the website at whiteintel.dev, the public REST API, the MCP server and related applications (together, the “Service”). By accessing or using the Service, or by clicking to accept, you agree to these Terms. If you use the Service for an organization, you accept these Terms on its behalf and represent that you are authorized to do so. Section 14 contains a binding arbitration agreement and class-action waiver that affect how disputes are resolved.

1. The Service

WhiteIntel aggregates and cross-references public-record and open-data sources — company registries, the Global LEI system, beneficial-ownership disclosures, sanctions lists and investigative leak datasets — into a searchable ownership graph with document-grounded analysis. It is an investigative decision-support tool. Outputs are leads for further inquiry, not a legal determination of ownership, identity, risk, creditworthiness, character or wrongdoing.

2. Not a consumer reporting agency (FCRA)

White Intel is not a “consumer reporting agency” and the Service is not a “consumer report”as those terms are defined in the U.S. Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) (“FCRA”). You may not use the Service, in whole or in part, as a factor in establishing any consumer’s eligibility for credit, insurance, employment, housing or tenant screening, or for any other purpose regulated by the FCRA or comparable state law. You are solely responsible for compliance with the FCRA, the Gramm-Leach-Bliley Act, the Driver’s Privacy Protection Act, applicable data-protection and anti-discrimination laws, and any use restrictions of the underlying data sources.

3. Eligibility & accounts

You must be at least 18 and able to form a binding contract. Some features require an account. You are responsible for the confidentiality and use of your credentials and API keys and for all activity under them. Provide accurate information and keep it current.

4. Acceptable use

You will not, and will not permit anyone to:

  • use the Service unlawfully, or to stalk, harass, threaten, defraud, discriminate against, or endanger any person;
  • use it for any FCRA-regulated eligibility decision (see §2) or other prohibited purpose;
  • re-identify, dox, or profile private individuals for harmful purposes;
  • scrape, crawl, bulk-download, or systematically extract the corpus to reconstruct, train a competing model on, or resell a competing dataset;
  • circumvent rate limits, entitlements, authentication, or security controls, or share API keys beyond your organization;
  • violate the license terms of any underlying data source (see §9), U.S. sanctions or export-control law, or third-party rights.

We may investigate and suspend or terminate access for suspected violations.

5. Data, accuracy & no warranty of results

The corpus is compiled from third-party public sources and may be incomplete, outdated, mismatched, or contain errors originating in those sources. A missing connection means “not observed in our sources,” not that it does not exist. We surface provenance and label unscored entities honestly, but we do not warrant the accuracy, completeness, currency, or fitness of any result, and you must independently verify information before relying on it. 6. Subscriptions, billing & refunds

Free features require no payment. Paid plans are sold as auto-renewing subscriptionsbilled in advance through our payment processor, Stripe. By subscribing you authorize recurring charges to your payment method each period until you cancel. Prices are shown at checkout (currently Pro €79/month and Team €990/month) and are exclusive of any taxes, which we may collect where required. You can view invoices, update your card, switch plans, or cancel at any time from the billing portal in your account settings; cancellation takes effect at the end of the current period and access continues until then. Except where required by law, fees already paid are non-refundable and partial periods are not prorated on cancellation. We may change prices or plans on reasonable prior notice effective for the next renewal.

7. API & fair use

The public API and MCP server are subject to rate limits and per-plan quotas that we may adjust to protect the Service. Keep your keys confidential; you are responsible for calls made with them. We may throttle, suspend, or revoke keys that abuse the Service or breach these Terms.

8. Intellectual property & your content

The Service — software, design, the compiled database, the resolution graph and documentation — is owned by White Intel or its licensors and protected by U.S. and international law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service under these Terms. Underlying public records remain subject to their own sources and licenses. Content you upload remains yours; you grant us a limited, worldwide license to host and process it solely to provide the Service to you, as described in the Privacy Policy. You represent you have the rights to upload it. We may use aggregated, de-identified usage data to operate and improve the Service.

9. Third-party data & licenses

Portions of the corpus derive from sources under their own licenses — including the ICIJ Offshore Leaks database (ODbL, attributed to ICIJ), GLEIF and OpenOwnership (public domain), and various official registries and sanctions lists. Your use of that data must comply with the relevant source license and attribution terms. Restricted sources are gated and may carry additional terms. See our Trust & Methodology page.

10. Copyright / DMCA

If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to intel@whiteintel.dev (subject: “DMCA”), including the elements the DMCA requires. We respond to valid notices and may remove allegedly infringing material and terminate repeat infringers.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WHITE INTEL AND ITS OFFICERS, MEMBERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) US $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You will indemnify, defend, and hold harmless White Intel from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your breach of these Terms or applicable law.

14. Dispute resolution — arbitration & class-action waiver

Please read this section carefully. You and White Intel agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer/Commercial Arbitration Rules, seated in Delaware (or by video/telephone), rather than in court — except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property. The Federal Arbitration Act governs this section. You and White Intel each waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing intel@whiteintel.dev within 30 days of first accepting these Terms, stating your name and intent to opt out.

15. Governing law

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to §14, the state and federal courts located in Delaware have exclusive jurisdiction for any matter not subject to arbitration.

16. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, to protect the Service, or to comply with law. Provisions that by their nature should survive (including §§2, 5, 8–15) survive termination.

17. Changes

We may update these Terms; material changes will be posted here with a new “last updated” date and, where appropriate, notified to account holders. Continued use after changes take effect constitutes acceptance.
